These Terms and Conditions ("Terms") govern the Pinterest marketing services provided by Switzertemplates ("we", "us", "our"), operated by Jane Switzer, based in Sydney, New South Wales, Australia. By engaging our services, submitting an onboarding form, or making payment, you ("Client") agree to be bound by these Terms in full.
1. Services
We offer Pinterest marketing services as described on this website, including but not limited to:
- Package 1 — Market Research & Strategy: niche audit, competitor analysis, keyword research, content gap analysis, pin design guidance, and a written strategy document.
- Package 2 — Strategy + Setup & Branding: everything in Package 1, plus Pinterest account setup and branding, board creation, pin template design, and initial pin scheduling.
The specific scope of work is as described on this website at the time of purchase. Any additional services outside the stated scope must be agreed in writing and may incur additional fees.
2. No guarantee of results
Pinterest marketing results vary significantly between accounts, industries, and time periods. We do not guarantee any specific outcome, including but not limited to follower growth, impression numbers, click-through rates, website traffic, email sign-ups, or sales.
Pinterest is a long-term traffic channel. Results typically build over 3–12 months. Factors outside our control that affect performance include, but are not limited to:
- How consistently the Client implements our strategy and recommendations after delivery
- The quality, quantity, and relevance of the Client's products, services, and content
- The Client's website, landing pages, and conversion rate
- Changes to the Pinterest algorithm or platform policies
- Seasonal trends and market conditions in the Client's industry
- The age, history, and existing standing of the Client's Pinterest account
- The level of competition in the Client's niche
Our services represent professional strategy and implementation work. The delivery of that work constitutes fulfilment of our obligations, regardless of subsequent performance outcomes.
3. Client responsibilities
The Client agrees to:
- Provide accurate, complete, and truthful information in the onboarding form and throughout the project
- Provide access to any accounts, platforms, or assets required to deliver the agreed services in a timely manner
- Respond to requests for feedback, approvals, or additional information within a reasonable timeframe (5 business days unless otherwise agreed)
- Implement our strategy and recommendations after delivery — we are not responsible for results that are not achieved due to lack of implementation
- Ensure their Pinterest account complies with Pinterest's Terms of Service at all times
- Not share, resell, or distribute our strategy documents, pin templates, or deliverables to third parties
Delays caused by the Client's failure to provide required information or access may result in revised delivery timelines at our discretion.
4. Account access
Where the Client provides Pinterest login credentials as part of the onboarding process, the Client confirms they are the legitimate account owner and authorises us to access the account solely for the purpose of delivering the agreed services.
We will handle login credentials with reasonable care. We are not responsible for any account suspension, restriction, or penalty imposed by Pinterest that arises from the Client's prior account activity, violation of Pinterest's policies, or circumstances outside our control.
The Client should change their Pinterest password following the completion of our engagement if they wish.
5. Payment
Payment is due in full prior to commencement of work unless otherwise agreed in writing. All prices are listed in USD on this website.
By making payment, the Client confirms they have read and agree to these Terms in full.
We reserve the right to withhold delivery of final deliverables until payment has been received and cleared.
6. Refund policy
Due to the nature of digital services and the significant time and expertise invested from the outset of each project, we do not offer refunds once work has commenced.
If you have concerns about the work delivered, please contact us within 7 days of delivery at hello@switzertemplates.com and we will work with you to address them in good faith.
Refunds will not be granted on the basis of results not being achieved, as results are dependent on factors outside our control as outlined in Section 2.
7. Intellectual property
Upon receipt of full payment, the Client is granted a non-exclusive licence to use the deliverables (strategy documents, pin templates, board covers, and related materials) for their own business purposes.
We retain the right to display work produced as part of our portfolio or for promotional purposes, unless the Client requests otherwise in writing prior to commencement.
The Client may not resell, sublicence, or distribute our deliverables to third parties.
8. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of the engagement. We will not disclose the Client's business strategies, financial information, or login credentials to any third party, except where required by law.
9. Limitation of liability
To the fullest extent permitted by applicable law, our total liability to the Client for any claim arising out of or in connection with these Terms or the services provided shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
We are not liable for any indirect, consequential, incidental, or special loss or damage including but not limited to loss of revenue, loss of profit, loss of business opportunity, or loss of data, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
11. Termination
Either party may terminate the engagement by providing written notice. In the event of termination:
- The Client is liable to pay for all work completed up to the date of termination
- No refund will be issued for work already completed
- We will deliver any completed work to the Client upon receipt of any outstanding payment
We reserve the right to terminate the engagement immediately and without refund if the Client behaves in a manner that is abusive, threatening, or unreasonable toward us.
12. Dispute resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith through direct communication. If the dispute cannot be resolved informally within 14 days, either party may refer the matter to mediation before pursuing any legal proceedings.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising out of or in connection with these Terms.
14. Changes to these Terms
We reserve the right to update these Terms at any time. The current version will always be published on this page. Continued use of our services after any changes constitutes acceptance of the updated Terms.
